Each card is identified by an invoice or recite number and can only be identified by the person(s) who paid that invoice. This is to keep my clients from being victims of being potentially harassed by outsiders, other clients or worst being doxed by malicious people.Your information is private, and will never be given out without proper reason.

Accepted forms of payment

Usually, payment is done via Paypal, however to be more accommodating for my clients. I do accept Square, Interact e-transfer, and even use Etsy with there partnership with Klara. to make things more financially easier on you.

I can also accept payment arrangements with clients via Paypal with in reason, and a fee may be added to compensate for the multiple transactions. Thanks in advance for your understanding.

Payment via interact e-transfer your email will be requested to be invoiced regardless of direct payment via e-transfer. This is to give us buyer and seller protection through PayPal.

You acknowledge (i) that you have read and understood these Terms and Conditions, (ii) that you are either more than 18 years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these terms and conditions, and to abide by and comply with these terms and conditions, and (iii) that these Terms and Conditions have the same force and effect as a signed agreement.

1.1 Privacy

All contact and personal information will not be sold to or shared with any third parties. All instant messages, VOIP, SMS, emails, screenshots, and audio, video, screen capture recordings. As well as, but not limited to, all current or future forms of communication, and will not be posted online but will be recorded and archived for future reference. This excludes comments posted or anything said during a group chat, stream chat, group call, or interactions on public networks and social media that is publicly viewable. In the event you receive mail with the artist’s address and/or personal information it is agreed upon that you do not share this information and erase, destroy, and/or forget said information. Sharing this information with any kind of intent is against this T.O.S. and will be dealt with legal actions.A line of communication will be established with the Client and the Client only.Such as and not limited to: Discord, Telegram, Email, Twitter, Skype, FurAffinity, Weasly, InkBunny, SoFurry, Facebook, Threads, Tiktok, Instagram, Twitch, Picarto, Piczel, Ko-Fi, or any other form specified by the client.This is to ensure privacy is kept with the party to receive updates and progress reports. Any other parties that attempt to contact the Artist about the Client's commission(s) will be recorded and sent to the Client as proof of interference.

1.2 Contact

E-mail, Discord and Telegram are methods of communication that are preferred. However, should the client wish to use a different form of communication they can specify so that further communications can be made without delay.All communication with the artist for commission ordering, status, refunding or any other business will be done via the client's chosen form of contact. However the default choice being email can be reached at: [email protected] . By starting communication with the artist you agree to all terms in the agreement.All contacts with the artist via email must have: Name of Client (Furry and/or Real), Use the Email of which payment was sent from.
(If the client is a minor, parental contact is required for consent purposes)

Client understands that it is their responsibility to keep contact information up to date. It is not the artists responsibility to seek out your new contact information and understand that if they do not update there contact information when changing it are at risk of forfeiting there commission. As seen in Section 6.

2. Conduct Agreement

The Artist reserves the right to refuse service at the Artist’s discretion.Non tolerable behavior will result in warnings.

Multiple warnings will result in a cancellation of the current commission with an appropriate refund and/or ban from future works (for more information on refunds, see section 6).

3. Revisions

Within an acceptable time frame; If you wish to cancel or change your commission please let the artist know as soon as possible. Once a commission has started, or is in the final stages; Inking, Coloring, or Shading.As it may not be possible to edit due to deadlines or the degree of changes requested. Commissions may only be edited upon the request of the Client up to seventy-eight (78) hours after artwork is deemed complete. After this time artwork will no longer be edited. Work in progress sketches/screenshots are not applicable for sketch commissions, since the Client is paying for a sketch and not a finished illustration.Multiple edits, full redraws may result in additional fees or charges. Including hourly rates, and potentially charged for a full redraw of the commission if it was already claimed as "compelete".You may also request your commission to be upgraded with in a reasonable time frame. ( One (1) to six (6) months time. )It is the Client's responsibility to present all information and correct references available for the artist to work with before any work is started.In the event of a group commission, it is encouraged that all Clients in a group commission consult with each other before contacting the Artist through a single message. Communication is key!In the event of illness, injury, or accidents the Artist will be in contact about rescheduling deadlines, cancellations, refunds, or other arrangements.

4. Reservation of Rights

All rights not expressly granted above are retained by the Artist, including any electronic rights or usage unless specified above and including, but not limited to, all rights in sketches, comps, or other preliminary materials. Any grant of rights is conditional upon receipt of full payments. Upon receipt of full payment, Artist shall deliver digital files necessary to enable Client’s usage rights granted herein. Any use additional to that expressly granted above requires arrangement for payment of a separate fee. Artist retains the rights to display all work created by Artist for any Client’s commission, including preliminary materials and final art, in Artist’ portfolios, including in print and online, and to submit such work to design periodicals and competitions.Licensing to display and post commissions must be solely allowed by the Artist to the Client. Accreditation to the Artist is also required.The use of the Artist’s characters or other intellectual property without the Artist’s consent is prohibited.Selling copies, prints or the use of the Artist’s work in other mediums is prohibited.All characters are property of their respective owners. The Artist will not sell copies of Client’s commission or character(s) without Client's consent.Any false claims of ownership of characters or art work will result in a cease and desist and legal action. This is to protect the Artist, the Client, and all works produced.Permission for the use and display of the Artist’s work will be granted at the Artist’s discretion. Your (Client, Third Party) request may also be denied and/or revoked at any time.The artist reserves the right to recycle sketches and base works for other commissions or personal works.Clients are NOT permitted, under any circumstances, to use any part of their commission for non fungible tokens. Use of the artwork for any advertising or profits associated with non fungible tokens (NFTs) or cryptocurrency is strictly prohibited.Clients are NOT permitted, under any circumstances, to submit, use, train, or use artist’s work(s) or likeness for use in AI (Artificial Intelligence) for digital or physical creation(s).Clients are NOT permitted, under any circumstances allowed to share or post work in progress images online to anyone with out the consent of the artist.The Client’s right to use the work is conditioned upon receipt of payment and upon compliance with the terms of this Agreement.Client acknowledges and agrees that the Artist retains all rights of copyright in all work created by the Artist for any Clients, including preliminary designs and Final DeliverablesThis Agreement shall be governed by the laws of Canada in the Province of Alberta.

5. Payment and Rush Fees

Payment for starting work is due upon acceptance of commission, net three (3) days.Character reference sheets require Fifty percent (50%) payment upfront before any progress is started, the final payment is due for final progress to be finished.Payment arrangements can be made between the artist and client should the client request it. The client is to contact the artist and make an agreement on a down payment, followed by a scheduled payment at a later date, or a given point of progress on the commission in question.HST/GST is not included in the price of the commission and will be added on for Canadian clients only.In the event that a Client needs a project(s) done sooner than the agreed upon timeline. Artist and client will discuss appropriate compensation to get the work done in the timely fashion with a minimum of one (1) month of advance notice.Payments can be received via Etsy with Klara, Interac E-Transfer, PayPal, and Square.

6. Refunds and Cancellation Fees

In the event that the Client requests a refund the Client must contact the artist via Email ( [email protected] ), or the agreed form of contact with the Clients information and Invoice Number.The Artist is required to respond to the Client in 7 (Seven) Business Days (If artist is away on Vacation; you will get an Automated Email back stating that the Artist is away and will respond back as soon as they return.)In the event of economic status, refunds will be worked out with the client.If no response has been established after a refusal to a refund after 48 hours; the Client therefore forfeits their refund and the Artist will keep funds.Should the client be unresponsive for a prolonged period of time. For example; Six (6) to Twelve (12)+ months. The client well forfeit their right to claim a full refund, as well as the artwork that was ordered and be classified as a kill fee.If client changes there original contact information, inform the artist as soon as possible. If client fails to inform the artist promptly their commission is at risk to be classified as abandoned and no refund or work will be produced.

For security purposes if you have changed the email of your original form of payment please be sure you email the artist with the original email the payment was received to inform the artist the change(s) with proof of payment. With both your old and your up to date contact information.

Refund Deductions:

Refund's will not given in full here. My services are my time and I need to be paid for it.

Communication -20% Working out details of what you'd like me to do.Draft -25% : The pose is being finalized and agreed on.Sketch -45% : Pose being refinedInks -75% : Details are being inked in.Color's -100% : No refund will be given.Shading : No refund will be given.

Artist Canceled Your Commission;

Refund may differ depending on the reason.

Subscriptions, Donations, Tips and Rush Fees

These things are not included in your refund, and will never be used as currency for any services or products.Subscription services i.e; Patreon, SubscribeStar may offer special services or products on a case by case bases.Rush fee's are you paying to push the artist, and can be deemed as a large tip. You will not be getting the funds returned or refunded even if the artist is unable to push to the desired deadline.

6.2 Returns

Merchandise Returns

Returns during a convention will not be accepted for sanitary purposes.Shop returns 20% will be ducted as a restock fee, as it has to be sanitized or washed, and potentially repacked as well as relisted.Buyer understands they are responsible for shipping costs. And are advised to include a tracking number with insurance on the package to insure it arrives safely to its destination. Along with taking any necessary precaution well repacking the item to be shipped back. i.e; placing a fursuit tail in a bag or wrapping it in saran wrap to protect it from unplanned moisture. Such as the elements during shipping.If item is damaged by the buyer or during its shipping process potential fees will be applied to the potential refund.Buyer has 14 days after receiving the item to return.

Stationary Products, such as but not limited to stickers, note pads and books.
Are not be eligible for return.Custom made Acrylic Keychains, Badges, Standees, and Dakimakura's are also not eligible for returns.

Custom Made Fursuit Parts & Accessories

Fursuit Parts, would be only eligible for premade item price. Along with 20% Restock fee.Buyer has 7 days after receiving the item to return.

7. Collaborations

Art collaborations with another Artist and/or Client in the making of a large project (i.e. Games; Comics; Novels; Prints) will be binded by both parties within the terms of service agreements.Section 8. Copyrights ( OwnerShip of copyright, Commercial Usage & Rights )The Client agrees to contracts drafted by both Artist and Client as well as rights associated with the contract of agreement. This contract is legal binding and will refer to that for Commercial Usages (i.e. Video Games, Publication, Video Distribution) as well as Rights to Usage.

9. Indemnification

The Client agrees to indemnify, defend, and hold the Artist harmless from and against all liability, claims, causes of action, damages, costs and expenses, including but not limited to: attorneys fees and costs of suit, arising out of your breach of these terms and conditions.

The Client and the Artist agree to comply with the provisions of the Code of Fair Practice.
